here is the whole story so get ready for a little read..
i refused a breathalyzer during a traffic stop for speeding. i refuse to take the breathalyzer as I was advised from Mark Shiner to never take a breathalyzer if pulled over if I had been drinking. I did share a bottle of wine on a dinner date.
Ieaving the restaurant I was pulled over for speeding. the officer said he smelled marijuana and asks me to get out of the car. I am immediately searched and handcuffed. then the officer searches my car and found a knife they consider illegal, about a 5 inch blade, about 2.5 grams pot in a pill holder you might find at any drug store, and a pipe. though this was my 2nd DUI just within a ten year time frame. I feel Melchiorree did a poor job representing me. he said he kept me from going to jail however based on what I had to do, I have serious doubts. I have to mention Jeaneane for her outstanding assistance and loyalty to both Melchiorre and Shiner.
Note: Attorney's are not insurance agents and should not be giving such advise !! he told me to maintain my insurance despite not being allowed to drive for a year. this coated me an additional $3,500.00 for 6 months. I did not renew..
also, despite refusing to do a breathalyzer when I was stopped, they forced me to take one at the police station. I blew 0.00. in retrospect, i could have passed the roadside breathalyzer. however this was never mentioned in court nor could I find the record anywhere. the police report said i was argumentative, and a bunch of other things including having in the car a cigarette shape pipe and about 2.5 grams of marijuana.
Melichiorre also told me I needed to maintain my insurance despite loosing my license for a year. this is completely WRONG information. if you loose your license, no hardship and loose all driving privileges, relinquish your insurance immediately. you simply would be paying for something you do not need. not until your license is reinstated or driving privileges.
I advise you to call
Florida Auto Plus Insurance and ask for Andrew. He knows insurance inside and out. He will give you sound and equitable advise !!
Rob Melchiorree took me in a conference room and Shiner asked if could come in and observe. I gave the okay. Rob simply wrote 2 numbers on the board $10,000.00 and $20,000.00
he did not explain or answer my question as to what the was the difference of representation between the two dollar amounts. i selected $10,000.00 and ended up with 70+ hours of community service, attend 14 counseling sessions at Best Life Counseling, attend a MADD class and a Safe Driving Class, and can't drive for 1 year. I overpaid for what I got in return, however who knows what the $20,000.00 would have brought. also, I was assigned a probation officer. she is a straight shooter. I do regular drug and alcohol screenings and am clear and free of all illegal drugs. I completed everything required by the court with the exception of seeing my probation officer 1 last time. oh, it would have been 12 meetings with the probation officer, but because I have adhered to the court orders, and been on the straight and narrow, I only have to see the probation officer 9 times. only one more visit, then it's a waiting game until November 28 when I can obtain my unrestricted drivers license.
