I received a Garnishment on an account with Capitol One that I never applied for (I have never & now will never have or apply for a Capitol One account after this experience). I immediately called & reported this as fraud. They told me the account had been opened in 2008 (I was 18, in college in another state from where the card address was) & that they put a warrant out in 2010, this is 9 years late & i'm just now finding out... When the guy looks into it, it turns out the account was paid off & the case is closed, so I call Capitol One to deal with the identity fraud part of things. & am told Nathan & Nathan will fax something to my work that day to have the garnishment released. It is over a week later & still nothing has been faxed. Today is payday & this will overdraft my account tomorrow as my regularly scheduled bills are coming out automatically. I have left message after message, begged for ANY sort of documentation & have been put on hold numerous times, all stating that this is MY FAULT & that they will not reimburse me the overdraft fee. I am at an absolute loss for what to do & they just keep throwing the blame at me. I have been trying for over a week to get this straightened out & they are absolutely NO HELP. I did not ask for my ID to be stolen. I hope everyone here gets hacked & treated like they have treated me.

Tried calling to settle debt several times as no one ever answers or returns messages. After reading reviews I’m not the only one who has had this issue. It’s quite ridiculous actually.

I've been trying to settle a debt with Capital One for some time. These guys never answer the phone. How are you running a business but never answering the phone? They don't keep much record of what you have already paid. I asked for a printout and they sent one of the blurriest copies. Capital One should've stuck with Buffaloe and Associates.

If you were not properly served with a copy of the lawsuit, write a letter to the judge with the CASE Number and the Court Name and state:" judge I want a hearing to set aside a judgment that was entered in this case and I am making the request for the following reason:_____________________________________________________________________________________________________________________________________________"
Some reasons: (1) you were not properly served; (2) you were not a party to the contract for the debt; (3) you have been the victim of identity theft.
All debt has a time limit, if the debt is old also state that this debt cannot be collected because it is too old. If the debt was incurred when you were under the age of 18, state that "I was a minor" and legally could not sign a contract to incur debt.
If you a victim of identity theft, file a police report. THEN, contact all three (3) credit bureaus and put a credit freeze on your accounts. THEN, contact all of your creditors and give them a copy of the police report and tell them IF the debt was incurred by someone other than yourself.
If your wages have been garnished, write a letter to the judge with your case number and the name of the court (this will be on the garnishment papers) and write: MOTION TO SET ASIDE DEFAULT JUDGMENT MY WAGES ARE EXEMPT AND MY PROPERTY IS EXEMPT, then tell the judge how much your gross wages are and state that the garnishment is depriving you of property and keeping you from being able to support yourself and your family.
IF none of the above works, filing bankruptcy is an option. Contact a bankruptcy attorney to see if this is the best option for you.
Where to get a copy of your papers to see the case number and judge name? THE COURTHOUSE. Go to the clerk's office or call the clerk's office.
Never consent to pay a debt over 6 years old: 6 years being from the date of the contract or the date of the last payment or the date of the last charge. Contact a lawyer to see if the 6 years applies to your debt.

Long story short. They stated that they served me papers in Nov. Of last year, but the description states the processor gave the paperwork to a white female with blonde hair...that was def not me. They are now garnishing wages out of my check, but they did not go thru the proper steps in actually 'serving' me. They are straight scammers!!! This is considered fraud. Something has to be done about this!!!

My wife had papers served at our home (so they obviously had our address) with no prior written communication or collection attempts. We had an attorney at the time and he filed for a continuance (a hurricane struck the day of our court date so it wouldn't have happened anyway). We never received another scrap of written communication from them until suddenly her boss comes into her work area, assuming she'd gotten notification of garnishment. She was so upset she nearly had to go to the ER!!! NO WRITTEN COMMUNICATION WHATSOEVER!!!! We never got any letters. They may have made "numerous attempts to contact you by phone" but with all the phone scammers these days, who answers unknown callers?

I deal with my husband's account. They stated they mailed a settlement letter to me..I never received it. And all they want to do is argue that they did and talk over me while I am telling them about our arrangements. Is this even a real law firm or just a 3rd party collection agency?
