Ms. McDaniel has been my attorney for almost two years during a very nasty, ugly divorce. She was able to have a post-marital settlement that was signed under duress and would have left me penniless after a 31 year marriage. She dealt with many untruths from my former husband, and when he lost the post marital settlement, he fired his original attorney and hired another attorney that put us back to almost square one. Because the divorce and other factors, Mary put up with my emotions that ran the spectrum from happiness to be rid of my former husband to pure anger over what the lies and accusations he was telling. She was very professional with her interactions with me and let me know when I was allowing my feelings to interfere with my common sense. While this was perhaps the worst situation I could imagine, the process was smooth and went very quickly. BEST EVER!! I was desperate and had talked to 3 other family lawyers in pensacola when my pastor recommended Mary. This is only my opinion but here are the facts: After speaking with Ms. McDaniel over the phone (I live in another state) and receiving her assurance that I had a good case to reduce or eliminate alimony, that I had been paying for 17 years; and assurance from Ms. McDaniel that my current wife's income and investments would not be considered in determining an appropriate amount of alimony, I agreed to hire Ms. McDaniel. Not being able to use my current wife's income was a very important factor in deciding whether to hire Ms. McDaniel. Because I was told it could not be used, I paid $3,500.00 to secure Ms. McDaniel's services. I sent the original court documents from my divorce to Ms. McDaniel that showed the exact amount of alimony being paid to be ex-wife. I also sent current financial documents to support that I was now retired and that my income had been greatly reduced. I sent joint federal income returns that showed how much money my current wife and I earned prior to our retirements; sent joint bank and credit card statements showing the amount of money being spent and the amount of money coming into our accounts. Those documents showed that my wife and I made a good income prior to our retirements. I also sent in a financial statement. My ex-wife also submitted financial documents. Ms. McDaniel never asked any questions about my income, investments or current lifestyle like the home I lived in, what it cost, the reason for the HELOC loan, my car, trips that were taken, etc. Ms. McDaniel never asked one question about my current wife's income, investments or any other relevant questions. I met with Ms. McDaniel in person and she again said there was Florida case law that supported my request to reduce or eliminate alimony. She again stated that I had a good case to go forward. Ms. McDaniel spent all the $3,500.00 and asked for another $2,500.00. I paid that amount because Ms. McDaniel convinced me that we had a strong case. The attorney for my ex-wife filed for an increase in the alimony based on my income and investments. A deposition was scheduled so each attorney could ask questions before any court hearing was scheduled. My attorney said she would object to any questions asked about my current wife's income and investments but she did not. The attorney for my ex-wife asked the questions MY attorney said he could NOT ask. He asked my current wife's income and her investments; probing questions that should have been asked by my attorney prior to the deposition, prior to the filing of court documents, prior to notifying my ex-wife of this pending action. My attorney stopped the deposition and said I should withdraw my case and pay my ex-wife's attorney his attorney fees, another $3,500.00, or I could suffer a worse fate at a court hearing. Ms. McDaniel was not prepared. She should have asked the same questions coming from the opposing counsel and should have known the answers to those questions before filing court documents and before the deposition. Because of bad advice, this cost me nearly $10,000.00 and I was forced to withdraw my request to modify the alimony. Because Ms. McDaniel allowed me to go to the deposition, my ex-wife now knows of my current wife's income and investments, and my own. And, most likely, in the future, my ex-wife will file legal action to increase her alimony.
This was a nightmare!
