I hired Xavier to represent me in negotiations with an insurance company after being involved in a serious boat accident.

Because of my injuries, I required significant ensuing medical treatment, so it was paramount for my attorney to understand my treatment, surgeries, and medical providers so that when communication and negotiations began with the insurance adjuster, he could talk intelligently about the facts.

Although he was contacting me for updates at least four or five times a week for nearly five months, was in possession of my diary that I maintained since the accident, had statements from all the occupants of the boat, had a listing of my medical providers, and was in possession of all the medical records and doctor's opinions, I had to continually tell Xavier the same things over and over. He would send drafts of letters for my approval and I would correct mistakes, but then less than a week later, he would send me similar letters that contained the same mistakes! Along with many other things I had to keep reiterating to him, it wouldn't be an overexaggeration to say I had to correct him with regard to one of my medical providers and his treatment at least 20 times.

I became extremely frustrated and told him I was displeased and inquired how many times I had to tell him the same things over and over, especially since he was in possession of all of the documents himself. Well, lo and behold, not four days later, after discussing at length the specific things that he kept getting wrong, I get his first draft of the demand letter to the adjuster and it was still incorrect. When reading his draft of the demand letter, my first thought was, "Whose case is he writing about? it certainly isn't mine." It was riddled with inaccuracies.

After five months of representing me, he didn't have even the basic facts of the accident correct, saying that I was thrown from the boat necessitating a water rescue when, in fact, he had to have heard AT LEAST 50 times that we hit the pylon, I flew into the center console, I was knocked out, the other occupants realized the boat was sinking fast so they got a lift jacket on me, and THEN, after the boat sank, I floated in the Ashley River awaiting rescue. Never once did I relay to him, nor do the statements from the other occupants indicate that I was thrown from the boat on impact.

As a result of my broken-up and bloody face, I was given a significant amount of fentanyl by the EMS en route to MUSC, so I don't have much of a memory of what transpired at the hospital. However, the medical records from the Trauma Center lay it out clearly. Instead of reading and digesting the records and getting a clear idea of what transpired, Xavier, in his demand letter to the adjuster, made up his own facts about my arrival and how things transpired after my arrival. I spent the time to sift through the records to make a timeline of how things transpired so I could redraft Xavier's letter so that the letter to the adjuster matched the facts laid out in the medical records she would also be receiving.

Since hiring Xavier a week after the accident, he had repeatedly told me he needed to come to Charleston to look at the scene and the boat. Five months later, he still hadn't accomplished that. It was only after I expressed concerns about his representation and we already were on the second draft of the settlement letter, almost to the end of the case, that he decided he better come and look at everything.

So I can't recommend Xavier at all to handle a case like this. When your life revolves around surgeries and doctors' appts. and a bumpy and lengthy recovery, you put a lot of trust and faith into your attorney, so make sure to pick one who will take the time required to know your case intimately so that they can advocate for you with vigor when the time comes. IMO, Xavier doesn't fit the bill. Two thumbs down.
