In May of 2018 I was falsely accused of possession after a labor dispute meeting with the Waco VA call center where I worked. I was accused of dropping what was described in court as a "white powdery substance" But when I was called to the Waco VA police office an hour after that meeting I was shown something that appeared to be broken rocks of a white and yellowy color, in a pristine clear plastic button bag. (like those that come with your new shirts) And the officer then informed me,( As he handled that bag with his bare hands) that it was methamphetamine.

I hired Ms Walker to help me with this case. I repeatedly asked that the bag be fingerprinted but Ms Walker for reasons known only to her, never asked or if she did she failed to share that with me. Had that bag been fingerprinted it would have proven beyond a shadow of a doubt that I never handled it ever,.As I knew I was innocent I asked for a trial. Ms Walker assured me that I should get a bench trial as that judge was known for demanding proof beyond a shadow of a doubt and I trusted her so I agreed to that bench trial. (NEVER AGREE TO A BENCH TRIAL) We went to court and she had me sign an evidence document on what was in the bag and I signed it, thinking the evidence would be physically in court, another move that might have ended this because it was NOT a white powdery substance as my accusers claimed. But the bag was not in court. Only Ms walker can say why.
So there I was in court being accused of dropping methamphetamine in spite of several clean drug tests, where the court spent I do not know how much money trying to get a dirty test out of me and failed again and again... and then they spent money on a forensic chemist to determine what was in the bag but not a penny was spent to fingerprint or produce that bag in court., Testimony given by all was that everyone handled the bag except for me. You would think the judge would have given pause, nope.
My accuser claims he sat one foot away from me,,, consider the length of a piece of paper,, 11.5" He said he observed the bag of white powder drop from my lap and bounce under my chair..First, the bag the officer showed had no wrinkles or divots one would expect had it been in my pile of things. Now put sugar or any powdery substance into a baggy regardless of the size and drop it,, does it bounce? I bet not. The judge accepted it and my lawyer never questioned it .
There was a lot of false information about the room it happened in, where were police photos? Is that not required in a criminal case? photos of the scene of the crime? never produced never taken and never requested.
In the end, the judge said the testimony of my accusers was proof beyond a shadow of a doubt and convicted me. (NO PHYSICAL EVIDENCE) The police found no drugs in me or on me. I was given a years probation at the end of which I will have a charge without a conviction. Ms. Walker tells me that was the best I could hope for,was it?
A drug charge means I can never teach again. Probation limits my ability to work my own business and who would hire a vet with a service dog on probation? my 2nd amendment rights have been stripped from me. I offered my hair sample and it was 3 times refused. My dignity was taken from me. Whether it was on purpose or not that my lawyer helped the other side there is no doubt. I am only giving you the facts of my case. I can not afford an appeal, even though I am told I have a great case for one, it will cost way more than I can ever afford so I will live the rest of my life with a drug charge on my record even if it was expunged nothing will ever remove the nightmare from my life.
DO NOT USE THIS LAWYER. She just took my money and showed up and punted then tried to convince me it was "the best thing that could have happened" .If I had been guilty it would be true. Maybe the judge prevented her from submitting that evidence.I was just a vet with PTSD so I must be a drug addict right? I wonder how many of her clients are convicted because of such sloppy work?
