Wish I could give -0 rating but, a 1 will do. I hired, or thought I hired an honest, group of attorneys who knew the law to represent me, my sister and handicapped,elderly parents fight and illegal eviction in the small town of Fairview. Was I wrong.
Red flag #1, during the initial consultation, the first words out of Carolyn's mouth were. "Why don't you leave the house?" "I mean, is it really worth fighting to stay?"
It's apparent now she had something up her sleeve. We wouldn't find out until Dana Hamilton lost the case for us what it actually was.
I'll get back to that in a minute.
Red flag #2, the minute the words, we were never late in rent and have paid rent before the due date, Carolyn literally jumped up and ran out the door, after practically choking on a piece of candy. Telling us, "I'll be right back!" 10 minutes passed, then 15. Felt like forever. Unbeknownst to us the rub was in the works. Now enter, Dana Hamilton, who Carolyn calls "the tough one."
Red flag #3, Dana is now representing me and my family. When asked, "should I notify the opposing attorney or courts that you are our attorney, she replied. "No, I want the element of surprise." Odd, I thought but ok, she's the professional.
7/25/2019 day of the trial.
We meet with Dana, 2 1/2 hrs. prior to the verdict. I provided all evidence that needed to prove and win our case.
Northcutt and Hamilton were absent from the docket. Meaning we had no legal representation.
She also made no objections to the judge's dismissal of my repair and remedy petition being heard together with the eviction (completely illegal) refusing to hear it and bailiff escorting me out of the courtroom without cause. Leaving a ghost attorney, opposing counsel, landlord and judge to discuss my eviction case without my presence. The trial proceeded without me or my witnesses for 15-20 minutes.
Now enters the rub.
Verdict in favour of landlord, tenants evicted for requesting repairs to a faulty sprinkler system and mold and holes in the attic
Conflict of interest:
Dana offered her moving boxes and Carolyn's rental home in Melissa, Tx. (3620 Applewood)
They've stolen our money and our verdict. She warned us against filing an appeal. She also told us she would work out a deal with opposing attorney to give us 11 days to move out.
Going from a 5br. exec. home @ 4,100sq ft to less than 1,800 sq.ft property already furnished for $2,400. This would put us further in debt paying month to month which can increase at any time in Texas forcing us to put all of our belongings in storage.

**In response to the attorneys' replies.
The eviction was never perfected a seasoned attorney would know this. The landlord with attorney filed an unlawful 3day vague vacate notice which failed to include dates, times, etc, included a collection's statement violating the FDCPA 2 days after the landlord acknowledged receipt of my repair request. By Tx. law the landlord cannot move to evict within 6 months of receiving a repair request. The repair/remedy petition was filed before we hired your office, 7/3, landlord filed a retaliatory eviction 9 days later, we hired your office 7days after. I'm not aware of any attorney protocol.
An attorney with 20 years of experience would've known this. When you perused all of the evidence I complied, you said our case was air tight, but should we lose at court, you would appeal it for us. At your entry at trial, you announced to the court that you were not on the docket for our case, you proceeded to not introduce pertinent information that would substantiate the plaintiff's culpability. You let the judge throw out our repair and remedy petition. The repair and remedy is a standalone petition and cannot be joined with any other countersuit. Any lawyer would

My experience with Dana was by far the smoothest and easiest during one of my most hardest and toughest times. Her whole staff is so understanding and reasonable. My divorce was as easy as one could be and I truly believe it was because Dana is so smart and knowledgeable. I hope to never need a divorce lawyer again but if I do Dana will be the first person I call!!! Highly recommend this office!!!
