I was arrested almost two years ago for a DUI. The charges were not filed against me until a year and a half later.
Because of the length of time in which these DUI charge were filed, I was not aware I was to appear for my court date...quite frankly I had forgotten about thus incident all together.
When I was arrested for a warrant due to a Family to Appear for these charges. Johnathan Warshaw was appointed as my public defender. I was distraught being detained and in custody when I met him for my initial court appearance back in November of 2018.
He took a special interest in my case. I noticed the personal attention he paid to the details of my charges. His argument for my arrest and the reasoning behind my Failure to Appear was more than I could have presented on my own behalf due to the circumstances of the stress of being in jail.
The thought of having to face a judge on charges that were old in which I had not thought of in almost 2 years was overwhelming.
I was ultimately charged with a misdemeanor. My sentence was better than I could have imagined.
I did not have to have the interlock, I did not have to do jail time, and Mr. Warshaw made sure I had the paperwork to reinstate my license as I walked out of court that day.
I was ordered to attend drug and alcohol counseling as part of my plea.
I was unable to complete these classes due to other financial obligations.
So I found myself in court on August 15th 2019 once again in contempt for not completing the court-ordered classes.
I was told I was going to have to serve 10 to 20 days in jail for my non-compliance.
Mr. Warshaw was once again my public defender. He asked me if I really wanted to do jail time? Of course my response was "absolutely not".
He told me he was going to try to get these classes reinstated and get my original sentence reinstated to give me a second chance.
The judge was understandably reluctant to reinstate these terms. Mr. Warshaw was very adamant that my circumstances would not repeat themselves and that I would be able to comply this time.
He basically stood up for my moral and ethical character even though we do not know each other personally. Throughout our conversation he took a personal interest and truly cared about the outcome.
I feel he had my best interest at heart and was not just doing his job as my Defending Attorney.
I could not be more pleased that the judge did reinstate my original sentence.
I was given a second chance all due to Johnathan Warshaw.
I was in court for over 4 hours this day. I did notice Mr. Warshaw took extra time on each individual case he defended that day.
Ultimately he cares about his defendants as people who have made a mistake and deserve a second chance.
He takes the time to listen and truly fights for the best outcome of his cases.
